Contract Law

The Walton Law Firm provides legal advice on contracts. Contracts are promises that the law will enforce. With few exceptions, all contracts regarding Land and Real Estate must be in writing. Otherwise, verbal contracts generally can also be enforced.

Deeds & Powers of Attorney

A deed is an unassuming and usually short piece of paper that has a big legal impact. A deed transfers an ownership interest in real property, and no real estate transaction where ownership transfers is finished until the deed is delivered to the buyer. A deed must include the names of the buyer and seller and the property’s legal description. The deed is signed by the person transferring the property and may make that person responsible to the buyer for other claims against or conditions on the property. A knowledgeable real estate attorney at The Walton Law Firm, can review the deed to ensure that it is accurate and properly executed.

The form and type of deed are critical. An experienced real estate lawyer at The Walton Law Firm, can analyze the circumstances surrounding your transaction, determine your needs, and review the content of the deed to ensure that the transfer is valid and appropriate.

A Power of Attorney is a powerful legal document that gives someone else right to act as though they are you, and the law will treat these actions as if you committed them yourself. If you are interested in having a Power of Attorney, consult with an attorney at Walton Jones + Browne to understand the risks and benefits, and to ensure the documents are properly prepared.

Foreclosure Law

Types of foreclosures representation

Community Association Lien Foreclosure

Mortgage Foreclosure Defense/Mortgage Modification Services
Financial hardship can happen to anyone. We know because our firm has represented hundreds of borrowers facing foreclosure by their lenders. Many times borrowers are willing to make payments, but the lender does not accept them.

Often, the best defense is a good offense. When mortgage lenders make mistakes, act irresponsibly or act maliciously, we seek to hold them accountable and secure the restitution and opportunities owed to our clients.

Many borrowers are unaware of their rights, and also of the most common violations of Federal regulations and Florida statutes that lenders commit. Such offenses can offset the money owed to the lender; eliminate their right to foreclose; entitle the borrower to rescind the loan; and/or require the lender to pay money to the borrower.

Rather than engage in lengthy litigation, our clients often ask us to help them modify the interest rate and/or the principle amount owed to the lender. In situations where we expose the lender’s liability, modifications are likely to occur. However, we have been successful at negotiating interest rate reductions and loan forgiveness when lenders are without fault, and even when the borrower has not yet defaulted on their loan.

Call us to schedule an evaluation of your mortgage situation.

Community Association Lien Foreclosure
Because of our vast experience representing Homeowner and Condominium Associations, we can advise you whether your association is wrongfully foreclosing on your property. Additionally, our experience also allows us to successfully negotiate repayment agreements for those persons who have fallen behind due to financial hardship.

Licensure Defense

We defend the licensure of Florida professionals before their licensure boards.

Real Estate Law

From commercial to residential or new construction, we have handled it all. We represent commercial and residential real estate developers in transactions throughout the State of Florida. We advise clients on and negotiate the structure, acquisition, construction, financing, leasing and sale of real estate ventures. These include apartment buildings, single-family residential developments, as well as residential and commercial condominium developments. In addition, we draft the governing documents for planned residential communities, including condominium documents and obtain any required governmental approvals of such documents.

We regularly practice in front of the county and circuit courts of Florida, dealing with foreclosures, title clearing actions, boundary disputes and other land related issues. We have worked with condominiums and homeowners’ associations on various issues including but not limited to enforcement, collections and drafting declarations and other association related documents.

We assist with title examinations. We also work with banks and other financial services companies doing commercial and residential real estate lending as well as private lenders involved in commercial and residential real estate lending, drafting their contracts and helping them keep in compliance. We also work with landlord and tenant cases.

If you are buying or selling a home, we can help the process go smoother. We can draft your sales contract or review a proposed sales contract with you. We can also assist with the negotiations. And with our vast experience and knowledge of the south Florida area, we can assist with any other glitches that show up during the process, such as title defects or unsatisfactory inspection results.
